2. Scope

These terms and conditions of sale (T&Cs) apply to any order placed on this site by a consumer. Validating the order constitutes acceptance of the T&Cs in force on that date.

3. Product

Nooki — Electric peeler, Royal Blue Edition: stainless steel blade, 1.2 L bowl, USB-C rechargeable. The main characteristics are set out on the product page. Photographs are as faithful as possible but are not contractually binding.

4. Prices

Prices are shown in euros, inclusive of all taxes. Delivery is free throughout Europe, including the United Kingdom. The price charged is the price displayed at the time of the order.

5. Ordering

The customer selects the product, checks their basket, enters their details, chooses the delivery method, then confirms the order with an obligation to pay. A confirmation email summarising the order, these T&Cs and the withdrawal form is sent to the customer.

6. Payment

Payment is due at the time of the order, by the means offered at checkout. Payments are secured by the payment service provider of the Shopify platform.

7. Delivery

Delivery throughout Europe, including the United Kingdom. The order is shipped within 3 to 7 working days. If the order is not delivered within the stated time, and at the latest 30 days after the order, the customer may terminate the contract under the conditions provided for in articles L. 216-2 et seq. of the French Consumer Code. The risk of loss or damage passes to the customer upon receipt of the product.

8. Right of withdrawal

In accordance with articles L. 221-18 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt of the product to withdraw, without having to give a reason.

Online withdrawal function: the customer may exercise this right directly on the site, via the link “Withdraw from the contract here”, available at the bottom of every page throughout the withdrawal period. They enter their name, their order number and the email address at which they wish to receive the acknowledgement of receipt, then click “Confirm withdrawal”. Nooki sends them an acknowledgement of receipt on a durable medium, stating the content of the statement as well as its date and time. The customer may also use the model form in our withdrawal policy, or any unequivocal statement.

The customer returns the product no later than 14 days after communicating their decision, to the following address: Maison ELK, 8206 Louisiana Blvd NE, Albuquerque, NM 87113, USA. Return costs are covered by Nooki: the customer writes to nooki.europe@gmail.com before dispatch so that Nooki can arrange the return. Nooki refunds all sums paid, including the initial delivery costs (based on the standard delivery method), no later than 14 days after being informed of the withdrawal. The refund may be deferred until the product has been recovered or proof of its dispatch has been provided. The customer may be held liable for any diminished value of the product resulting from handling other than that necessary to establish its nature, characteristics and proper functioning.

9. Legal guarantees

The product benefits from the legal guarantee of conformity (articles L. 217-3 et seq. of the French Consumer Code) and from the legal guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code).

The consumer has a period of two years from delivery of the goods to enforce the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or end the contract and be fully refunded against return of the goods, if: 1° the trader refuses to repair or replace the goods; 2° the repair or replacement of the goods takes place after a period of thirty days; 3° the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of collecting or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° the lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for the purposes of repair or replacement suspends the guarantee remaining to run until the repaired goods are delivered.

The rights referred to above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

11. Consumer mediation

In the event of a dispute, the customer first sends a written complaint to our customer service (nooki.europe@gmail.com). Nooki has not yet joined a consumer mediation scheme.

13. Applicable law

These T&Cs are governed by French law. This clause does not deprive a consumer residing in another Member State of the protection afforded to them by the mandatory provisions of the law of their country of residence.
